1. ACCEPTANCE, OPERATOR, AND KAISEI FRAMEWORK
By creating an account, purchasing a Plan, or using ETERNAL, the responsible adult agrees to these Terms on their own behalf and, where legally permitted, on behalf of the minor profile they manage. Minors may not independently accept contractual terms where the law requires adult authorization.
ETERNAL is a Venture of KAISEI. These ETERNAL-specific Terms supplement the KAISEI General Terms. If a provision conflicts, the ETERNAL-specific provision governs this Service to the extent permitted by law. Mandatory consumer, privacy, child-protection, and other non-waivable rights remain unaffected.
2. PURPOSE AND PERMITTED USE
ETERNAL is an educational and family-support technology product. It may provide learning activities, personalization, progress views, routines, guidance, and related digital experiences. Users agree to:
- use the Service lawfully and only for authorized purposes;
- not attempt to bypass security, parental controls, access controls, rate limits, or technical protections;
- not upload or introduce content they lack authority to share, malicious code, credentials, unnecessary sensitive information, or unlawful material;
- provide accurate account information and promptly update material changes.
ETERNAL is not a medical device, emergency service, psychotherapy service, diagnostic instrument, legal service, or substitute for qualified professional judgment unless a specific feature expressly states otherwise and is legally authorized for that purpose.
3. MINORS, PARENTAL SUPERVISION, AND CONSENT
Adult account holders are responsible for configuring and supervising a minor's use. Where applicable law requires verifiable parental consent before collecting, using, or disclosing a child's personal information, ETERNAL will use a method reasonably designed to verify adult authorization and appropriate to the processing. A simple self-declared age or isolated checkbox is not treated as sufficient where a higher standard applies.
The adult is responsible for reviewing settings, permissions, purchases, external links, and the suitability of activities for the minor. ETERNAL may restrict features, require additional verification, or suspend a child profile if necessary to protect safety, comply with law, or satisfy platform requirements. See our Children & Teen Privacy Notice.
4. PRIVACY, DATA, AND CHILD SAFEGUARDS
Our collection and use of personal information is governed by the Privacy Policy, Children & Teen Privacy Notice, and related notices. We do not sell children's personal information or use it for behavioral advertising. The precise data collected, vendors used, and permissions requested must match the actual product version.
Our program is designed to address applicable child-privacy and platform requirements, including COPPA where applicable, Mexican privacy law, and other mandatory rules triggered by the relevant user and processing. This statement is not a representation that every privacy statute worldwide applies to or has independently certified ETERNAL.
5. PARENTAL CONTROLS AND FAMILY RESPONSIBILITY
The responsible adult must protect their PIN, credentials, devices, and recovery methods; review the minor's use; keep contact information current; and respond appropriately to safety notifications. Parental controls reduce risk but do not replace active adult supervision. If a feature fails to notify, sync, or display information, the adult must not rely on ETERNAL as the sole mechanism for protecting a child.
6. ACCOUNT SECURITY
Users are responsible for maintaining credential confidentiality and notifying us of suspected unauthorized access. ETERNAL may use authentication, access controls, logging, rate limits, fraud-prevention controls, and other reasonable safeguards. No technology is perfectly secure. To the extent permitted by law, KAISEI/ETERNAL is not responsible for losses caused solely by voluntary credential disclosure, phishing or social engineering, compromised user devices, password reuse, or acts attributable to the user or persons under their control.
7. DISCLAIMERS, PROFESSIONAL SERVICES, AND ALLOCATION OF RISK
ETERNAL is an evolving technology service that can depend on devices, networks, third-party providers, integrations, user-entered information, and factors outside our reasonable control. Unless an express written warranty applies, and without affecting mandatory rights, we do not warrant that every feature will be uninterrupted, error-free, compatible with every device, fit for every undocumented use case, or produce a particular educational, developmental, therapeutic, or behavioral outcome.
Content, recommendations, classifications, and AI-assisted outputs are informational/supportive and do not replace medical, psychological, therapeutic, legal, educational, tax, financial, or other professional judgment. The Limited Liability Notice forms part of these Terms, subject always to limitations that applicable mandatory law does not permit parties to exclude.
8. AVAILABILITY, MAINTENANCE, BETAS, CHANGES, AND FORCE MAJEURE
We may perform scheduled or emergency maintenance, migrations, architecture changes, capacity adjustments, security fixes, provider substitutions, model changes, or feature revisions. Features labeled beta, experimental, preview, pilot, or similar may change or be withdrawn and are not promised to continue. No uptime percentage, recovery time, or service-level agreement is promised unless stated in a signed institutional contract.
To the fullest extent permitted by law, we are not liable for delay or unavailability caused by events outside reasonable control, including widespread internet/cloud failures, critical-provider outages, government actions, labor disputes, natural disasters, fire, flooding, epidemics, war, terrorism, civil disorder, power failures, denial-of-service attacks, third-party vulnerabilities, or equivalent events. We will use reasonable continuity measures when technically and commercially feasible.
9. PLANS, PRICES, SUBSCRIPTIONS, AND STORE BILLING
Plans, packages, prices, fees, discounts, scholarships, promotions, rewards, commissions, and other amounts displayed by ETERNAL or KAISEI may change, be discontinued, or be replaced at any time, except that active subscribers will receive any notice or consent opportunity required by applicable law or the relevant store policy. The price governing a specific purchase or renewal is the price displayed and confirmed for that transaction by the applicable checkout/store, not a price shown at another time.
Apple App Store or Google Play purchases are also subject to the store's billing, renewal, cancellation, refund, and family-purchase controls. ETERNAL does not receive full payment-card credentials processed solely by the store. Canceling an ETERNAL account and canceling an App Store/Google Play subscription are separate actions. Refund rights are determined by applicable law and the applicable store/payment-provider policy.
10. INTELLECTUAL PROPERTY AND USER INPUT
ETERNAL software, visual identity, worlds, characters, designs, text, audiovisual content, trademarks, code, and other materials are protected by intellectual-property laws and may not be copied, reverse engineered, redistributed, or commercially exploited except as expressly allowed by law or written authorization.
The user retains rights they lawfully hold in information they provide. The user grants KAISEI/ETERNAL the limited rights necessary to host, process, transform, and transmit that input solely to provide, secure, improve where permitted, and support the Service consistent with the Privacy Policy and applicable consent choices. Users must not submit third-party content they are not authorized to use.
11. ACCOUNT CANCELLATION AND DATA DELETION
Where account creation is enabled, the adult may initiate account deletion through the available in-app path and may also use our public Account & Data Deletion page. We will delete associated personal data except where retention is legally permitted or required for security, fraud prevention, transactions, legal claims, compliance, or another lawful exception.
Deleting an account may permanently remove progress and access. Subscription cancellation must also be completed through the billing platform when applicable.
12. GOVERNING LAW, MANDATORY RIGHTS, AND INTERNATIONAL USE
These Terms are administered from Mexico and are interpreted with applicable Mexican law and the KAISEI General Terms. Users accessing the Service from other jurisdictions are also subject to mandatory rules applicable to them. No provision is intended to waive consumer, privacy, child-protection, store-platform, or other rights that cannot lawfully be waived.
Contractual forum-selection, individual-claim, arbitration, notice, limitation-period, or liability provisions apply only to the extent legally enforceable for the specific user and dispute. Nothing prevents a user from contacting a competent regulator or exercising a non-waivable statutory remedy.
13. ARTIFICIAL INTELLIGENCE AND AUTOMATION
One or more ETERNAL features may use artificial intelligence, machine learning, language models, recommendation systems, classifiers, or other automation. Automated outputs can be probabilistic, incomplete, outdated, or incorrect. They are support tools and not professional diagnoses or guaranteed facts.
Where the user directly interacts with an automated assistant or generative feature, ETERNAL will seek to make that automated nature reasonably apparent. Personal information will not be sent to a third-party AI provider without any permission specifically required by applicable law or platform policy. ETERNAL does not intend to use a child's sensitive information for behavioral advertising or unrestricted third-party model training. See the AI & Automation Notice.
ETERNAL will not knowingly rely solely on an automated output to make a legally or similarly significant high-impact decision about a child where the law requires human involvement, notice, consent, or an appeal mechanism.
14. THIRD-PARTY SERVICES, SDKs, AND APP STORES
ETERNAL may integrate or link to independent services. Those services control their own availability, security, content, prices, and terms. KAISEI/ETERNAL is responsible only for obligations legally or contractually attributable to it and does not assume an independent third party's duties. Integrations used in child-directed contexts must be selected and configured consistently with applicable child-privacy and store requirements.
15. SUSPENSION, CHANGES TO TERMS, SEVERABILITY, AND PRECEDENCE
We may suspend or restrict accounts reasonably believed to create security, safety, legal, fraud, abuse, or policy risks, subject to mandatory rights and notice requirements. We may update these Terms for legal, technical, business, or feature changes. Material changes will receive additional notice or consent when required.
If a provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remainder remains effective. ETERNAL-specific terms prevail over general KAISEI terms solely for an ETERNAL-specific conflict; mandatory law prevails over both.

1. ACEPTACIÓN, OPERADOR Y MARCO KAISEI
Al crear una cuenta, adquirir un Plan o utilizar ETERNAL, la persona adulta responsable acepta estos Términos por cuenta propia y, cuando jurídicamente proceda, respecto del perfil del menor que administra. Las personas menores no aceptan independientemente obligaciones contractuales cuando la ley exige autorización adulta.
ETERNAL es una Venture de KAISEI. Estos Términos específicos complementan las Condiciones Generales de KAISEI. Si existe contradicción, la disposición específica de ETERNAL regirá este Servicio en la medida permitida por la ley. Los derechos imperativos de consumidores, privacidad, protección infantil y demás derechos irrenunciables permanecen intactos.
2. FINALIDAD Y USO PERMITIDO
ETERNAL es un producto tecnológico de educación y apoyo familiar. Puede ofrecer actividades de aprendizaje, personalización, progreso, rutinas, orientación y experiencias digitales relacionadas. El usuario se compromete a:
- utilizar el Servicio de forma lícita y únicamente para fines autorizados;
- no evadir seguridad, controles parentales, controles de acceso, límites de uso o protecciones técnicas;
- no introducir contenido que no esté autorizado a compartir, código malicioso, credenciales, información sensible innecesaria o material ilícito;
- proporcionar información de cuenta correcta y actualizar cambios relevantes.
ETERNAL no es un dispositivo médico, servicio de emergencias, servicio de psicoterapia, instrumento diagnóstico ni sustituto de criterio profesional calificado, salvo que una función específica lo indique expresamente y esté jurídicamente autorizada para ello.
3. MENORES, SUPERVISIÓN Y CONSENTIMIENTO PARENTAL
La persona adulta titular de la cuenta es responsable de configurar y supervisar el uso del menor. Cuando la ley aplicable requiera consentimiento parental verificable antes de recopilar, utilizar o divulgar información personal de un niño —incluyendo COPPA cuando corresponda— ETERNAL utilizará un método razonablemente diseñado para verificar la autorización adulta y adecuado al tratamiento. Una simple declaración de edad o casilla aislada no se considera suficiente cuando exista un estándar legal superior.
El adulto debe revisar configuraciones, permisos, compras, enlaces externos y la idoneidad de las actividades. ETERNAL podrá restringir funciones, pedir verificación adicional o suspender un perfil infantil cuando sea necesario por seguridad, cumplimiento legal o reglas de plataforma. 4. PRIVACIDAD, DATOS Y SALVAGUARDAS PARA MENORES
La recopilación y uso de información personal se rigen por la Política de Privacidad, el Aviso de Privacidad Infantil y avisos relacionados. No vendemos información personal de menores ni la utilizamos para publicidad conductual. Los datos, proveedores y permisos descritos deben corresponder a la versión real del producto.
Nuestro programa está diseñado para atender los requisitos de privacidad infantil y plataforma que resulten aplicables, incluyendo COPPA cuando corresponda, la legislación mexicana de privacidad y otras normas imperativas activadas por el usuario y tratamiento concretos. Esto no constituye una declaración de que todas las leyes de privacidad del mundo sean aplicables a ETERNAL ni una certificación independiente de cumplimiento.
5. CONTROLES PARENTALES Y RESPONSABILIDAD FAMILIAR
La persona adulta responsable debe proteger PIN, credenciales, dispositivos y métodos de recuperación; revisar el uso del menor; mantener actualizados sus datos de contacto; y reaccionar apropiadamente ante avisos de seguridad. Los controles parentales reducen riesgos, pero no sustituyen la supervisión adulta activa. Si una función no notifica, sincroniza o muestra información, el adulto no debe depender de ETERNAL como único mecanismo para proteger al menor.
6. SEGURIDAD DE CUENTA
El usuario es responsable de la confidencialidad de sus credenciales y de notificarnos accesos sospechosos. ETERNAL puede utilizar autenticación, controles de acceso, registros, límites, prevención de fraude y otras medidas razonables. Ninguna tecnología es completamente segura. En la medida permitida por la ley, KAISEI/ETERNAL no responde por pérdidas causadas exclusivamente por entrega voluntaria de credenciales, phishing o ingeniería social, dispositivos del usuario comprometidos, reutilización de contraseñas o actos atribuibles al usuario o personas bajo su control.
7. GARANTÍAS, SERVICIOS PROFESIONALES Y ASIGNACIÓN DE RIESGOS
ETERNAL es un servicio tecnológico evolutivo que puede depender de dispositivos, redes, proveedores, integraciones, información introducida por usuarios y factores fuera de nuestro control razonable. Salvo garantía expresa por escrito y sin afectar derechos irrenunciables, no garantizamos que toda función sea ininterrumpida, libre de errores, compatible con todo dispositivo, adecuada para usos no documentados ni que produzca un resultado educativo, de desarrollo, terapéutico o conductual específico.
El contenido, recomendaciones, clasificaciones y resultados apoyados por IA son informativos/de apoyo y no sustituyen diagnóstico, atención médica, psicológica, terapéutica, legal, educativa, fiscal, financiera u otro criterio profesional. El Aviso de Responsabilidad Limitada forma parte de estos Términos, siempre sujeto a los límites que una ley imperativa no permita excluir.
8. DISPONIBILIDAD, MANTENIMIENTO, BETAS, CAMBIOS Y FUERZA MAYOR
Podemos realizar mantenimiento programado o de emergencia, migraciones, cambios de arquitectura, ajustes de capacidad, correcciones de seguridad, sustitución de proveedores, cambios de modelos o modificaciones de funciones. Las funciones beta, experimentales, preview, piloto o equivalentes pueden cambiar o retirarse y no tienen garantía de continuidad. Ningún porcentaje de disponibilidad, recuperación o SLA se promete salvo que conste en un contrato institucional firmado.
En la máxima medida permitida por la ley, no respondemos por retrasos o indisponibilidad ocasionados por eventos fuera de nuestro control razonable, como fallas generalizadas de internet/nube, interrupciones de proveedores críticos, actos de autoridad, conflictos laborales, desastres naturales, incendios, inundaciones, epidemias, guerra, terrorismo, disturbios, fallas eléctricas, ataques de denegación de servicio, vulnerabilidades de terceros o eventos equivalentes. Aplicaremos medidas razonables de continuidad cuando sean técnica y comercialmente viables.
9. PLANES, PRECIOS, SUSCRIPCIONES Y COBROS DE TIENDA
Todos los planes, paquetes, precios, cuotas, descuentos, becas, promociones, recompensas, comisiones y montos mostrados por ETERNAL o KAISEI pueden cambiar, descontinuarse o reemplazarse en cualquier momento, salvo que la ley aplicable o la política de la tienda exija aviso o consentimiento para suscriptores activos. El precio vigente para una compra o renovación específica es el que se muestra y confirma para esa transacción en el checkout/tienda correspondiente, no un precio mostrado en otro momento.
Las compras realizadas mediante Apple App Store o Google Play están sujetas también a los controles de facturación, renovación, cancelación, reembolso y compras familiares de la tienda. ETERNAL no recibe los datos completos de tarjeta procesados exclusivamente por la tienda. Cancelar una cuenta ETERNAL y cancelar una suscripción de App Store/Google Play son acciones distintas. Los derechos de reembolso dependen de la legislación aplicable y de las políticas de la tienda/proveedor de pago correspondiente.
10. PROPIEDAD INTELECTUAL Y CONTENIDO DEL USUARIO
El software, identidad visual, mundos, personajes, diseños, textos, contenido audiovisual, marcas, código y demás materiales de ETERNAL están protegidos por legislación de propiedad intelectual y no pueden copiarse, reverse-engineerarse, redistribuirse o explotarse comercialmente salvo autorización legal o escrita.
El usuario conserva los derechos que legítimamente tenga sobre la información que aporta. Otorga a KAISEI/ETERNAL únicamente los derechos limitados necesarios para alojar, procesar, transformar y transmitir dicha información a fin de prestar, asegurar, apoyar y, cuando esté permitido, mejorar el Servicio conforme a la Política de Privacidad y las opciones de consentimiento. No debe introducir contenido de terceros que no esté autorizado a usar.
11. CANCELACIÓN DE CUENTA Y ELIMINACIÓN DE DATOS
Cuando exista creación de cuenta, la persona adulta puede iniciar la eliminación mediante la ruta disponible dentro de la app y también mediante nuestra página pública de Eliminar Cuenta y Datos. Eliminaremos los datos personales asociados, salvo cuando una retención esté permitida o exigida por seguridad, prevención de fraude, transacciones, reclamaciones, cumplimiento u otra excepción lícita.
Eliminar la cuenta puede suprimir permanentemente progreso y acceso. La cancelación de una suscripción debe realizarse además en la plataforma de cobro cuando corresponda.
12. LEY APLICABLE, DERECHOS IMPERATIVOS Y USO INTERNACIONAL
Estos Términos se administran desde México y se interpretan con la legislación mexicana aplicable y las Condiciones Generales de KAISEI. Quien acceda desde otras jurisdicciones también queda sujeto a las normas imperativas que le resulten aplicables. Ninguna disposición pretende renunciar derechos de consumidores, privacidad, protección infantil, reglas de plataforma u otros derechos que legalmente no puedan renunciarse.
Las cláusulas contractuales de foro, reclamación individual, arbitraje, aviso previo, prescripción o límite de responsabilidad operan únicamente en la medida en que sean jurídicamente exigibles para el usuario y controversia concretos. Nada impide acudir a una autoridad competente o ejercer un recurso legal irrenunciable.
13. INTELIGENCIA ARTIFICIAL Y AUTOMATIZACIÓN
Una o más funciones de ETERNAL pueden utilizar inteligencia artificial, aprendizaje automático, modelos de lenguaje, sistemas de recomendación, clasificadores u otras automatizaciones. Los resultados automatizados pueden ser probabilísticos, incompletos, desactualizados o incorrectos. Son herramientas de apoyo y no diagnósticos profesionales ni hechos garantizados.
Cuando el usuario interactúe directamente con un asistente automatizado o una función generativa, ETERNAL procurará que la naturaleza automatizada sea razonablemente perceptible. No enviaremos información personal a un proveedor externo de IA sin obtener el permiso adicional que específicamente exijan la ley aplicable o las políticas de plataforma. ETERNAL no pretende utilizar información sensible de un menor para publicidad conductual ni entrenamiento irrestricto de modelos de terceros. Consulta el Aviso de IA y Automatización.
ETERNAL no dependerá conscientemente solo de una salida automatizada para adoptar una decisión de alto impacto legal o similar sobre un menor cuando la ley exija participación humana, aviso, consentimiento o mecanismo de revisión.
14. SERVICIOS DE TERCEROS, SDK Y TIENDAS DE APPS
ETERNAL puede integrar o enlazar servicios independientes. Dichos terceros controlan su disponibilidad, seguridad, contenido, precios y términos. KAISEI/ETERNAL responde únicamente por obligaciones legal o contractualmente atribuibles a sí mismo y no asume las obligaciones propias de un tercero independiente. Las integraciones usadas en contextos dirigidos a menores deben seleccionarse y configurarse de forma coherente con las reglas aplicables de privacidad infantil y tiendas.
15. SUSPENSIÓN, CAMBIOS DE TÉRMINOS, DIVISIBILIDAD Y PRELACIÓN
Podemos suspender o restringir cuentas cuando razonablemente exista riesgo de seguridad, protección, legal, fraude, abuso o incumplimiento, sujeto a derechos y avisos obligatorios. Podemos actualizar estos Términos por cambios legales, técnicos, comerciales o funcionales. Los cambios materiales recibirán aviso adicional o consentimiento cuando sea exigible.
Si una disposición es inexigible, se limitará o separará en la medida mínima necesaria y el resto seguirá vigente. Los términos específicos de ETERNAL prevalecen sobre los generales de KAISEI únicamente ante un conflicto específico de ETERNAL; la ley imperativa prevalece sobre ambos.
