1. ACCEPTANCE

The use of the ETERNAL application implies the acceptance of these terms by the father, mother, or legal guardian. ETERNAL is designed exclusively for children under 13 under parental supervision.

2. USE OF THE APPLICATION

ETERNAL is an educational application aimed at supporting learning, especially for minors with neurodivergence. The user agrees to:

  • Use the application in accordance with applicable legislation.
  • Not attempt to breach the system's security.
  • Provide truthful information.

3. REGISTRATION AND PARENTAL CONSENT (COPPA)

Registration must be performed by a responsible adult. Verifiable parental consent is required before collecting any data from the minor. The legal guardian has the right to:

  • Review the minor's information.
  • Request correction or deletion.
  • Revoke consent at any time.

4. PRIVACY AND DATA PROTECTION (GDPR / COPPA)

We only collect data necessary for educational purposes. We do not sell or share personal data with third parties for commercial purposes.

We implement technical and organizational security measures to protect information. Data may include: educational progress, settings, and app usage. Processing complies with:

  • COPPA (USA)
  • GDPR (European Union, where applicable)

5. PARENTAL CONTROL

The legal guardian has access to:

  • Minor's progress and activity within the application.
  • Usage settings and account/data deletion.

ETERNAL promotes active supervision by the responsible adult.

6. SECURITY

We apply measures such as data protection through encryption (where applicable), restricted access, and secure storage best practices. However, no system is completely infallible.

7. LIMITATION OF LIABILITY

ETERNAL is an educational tool and does not replace professional medical, psychological, or therapeutic care. We do not guarantee specific results. We are not responsible for the misuse of the application or decisions made based on its content.

8. SERVICE AVAILABILITY

We may update, modify, or suspend service features. When possible, we will notify users of relevant changes.

9. SUBSCRIPTIONS AND PAYMENTS

ETERNAL offers optional auto-renewable subscriptions ("Plans") purchased through the Apple App Store or Google Play. By purchasing a Plan, the responsible adult acknowledges and agrees that:

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
  • Subscriptions automatically renew for the same period and price shown at checkout unless canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase.
  • Free trials, when offered, convert automatically into a paid subscription unless canceled before the trial ends.
  • You can manage or cancel your subscription anytime in your Apple ID (Settings → [your name] → Subscriptions) or Google Play (Play Store → Menu → Subscriptions) account settings — canceling within the app is not sufficient on its own.
  • No refund is issued for the unused portion of a period already paid for, except where required by applicable law or by Apple's / Google's own refund policies.
  • Prices may vary by region and are subject to change; we will notify active subscribers of price changes in advance as required by the applicable store's policies.
  • In-app purchases are protected behind the responsible adult's PIN and are never accessible directly to the child profile.

10. INTELLECTUAL PROPERTY

All content, design, code, and materials of ETERNAL are protected by copyright. Reproduction without authorization is prohibited.

11. CANCELLATION AND DATA DELETION

The guardian may delete the account at any time or request the total deletion of the minor's data. We may also suspend accounts that violate these terms.

12. APPLICABLE LAW

These terms are governed by the laws of Mexico, as well as applicable international regulations regarding child data protection.

1. ACEPTACIÓN

El uso de la aplicación ETERNAL implica la aceptación de estos términos por parte del padre, madre o tutor legal. ETERNAL está diseñada exclusivamente para menores de 13 años bajo supervisión parental.

2. USO DE LA APLICACIÓN

ETERNAL es una aplicación educativa orientada a apoyar el aprendizaje, especialmente en menores con neurodivergencia. El usuario se compromete a:

  • Utilizar la aplicación conforme a la legislación aplicable.
  • No intentar vulnerar la seguridad del sistema.
  • Proporcionar información veraz.

3. REGISTRO Y CONSENTIMIENTO PARENTAL (COPPA)

El registro debe ser realizado por un adulto responsable. Se requiere consentimiento parental verificable antes de recopilar cualquier dato del menor. El tutor legal tiene derecho a:

  • Revisar la información del menor.
  • Solicitar corrección o eliminación.
  • Revocar el consentimiento en cualquier momento.

4. PRIVACIDAD Y PROTECCIÓN DE DATOS (GDPR / COPPA)

Recopilamos únicamente los datos necesarios para fines educativos. No vendemos ni compartimos datos personales con terceros para fines comerciales.

Implementamos medidas de seguridad técnicas y organizativas para proteger la información. Los datos pueden incluir: progreso educativo, configuraciones y uso de la app. El tratamiento cumple con:

  • COPPA (EE.UU.)
  • GDPR (Unión Europea, cuando aplique)

5. CONTROL PARENTAL

El tutor legal tiene acceso a:

  • Progreso del menor y actividad dentro de la aplicación.
  • Configuración de uso y eliminación de cuenta y datos.

ETERNAL promueve la supervisión activa del adulto responsable.

6. SEGURIDAD

Aplicamos medidas como protección de datos mediante cifrado (cuando aplique), accesos restringidos y buenas prácticas de almacenamiento seguro. Sin embargo, ningún sistema es completamente infalible.

7. LIMITACIÓN DE RESPONSABILIDAD

ETERNAL es una herramienta educativa y no sustituye atención médica, psicológica o terapéutica profesional. No garantizamos resultados específicos. No somos responsables por el uso indebido de la aplicación o decisiones tomadas con base en el contenido de la misma.

8. DISPONIBILIDAD DEL SERVICIO

Podemos actualizar, modificar o suspender funcionalidades del servicio. Cuando sea posible, notificaremos cambios relevantes a los usuarios.

9. SUSCRIPCIONES Y PAGOS

ETERNAL ofrece suscripciones opcionales de renovación automática ("Planes") que se compran a través de la App Store de Apple o Google Play. Al comprar un Plan, el adulto responsable reconoce y acepta que:

  • El pago se carga a tu cuenta de Apple ID o Google Play al confirmar la compra.
  • Las suscripciones se renuevan automáticamente por el mismo periodo y precio mostrados al momento de la compra, a menos que se cancelen al menos 24 horas antes de que termine el periodo vigente.
  • Tu cuenta será cargada por la renovación dentro de las 24 horas previas al fin del periodo actual, al precio que aceptaste al momento de la compra.
  • Las pruebas gratuitas, cuando se ofrecen, se convierten automáticamente en suscripción de pago si no se cancelan antes de que termine el periodo de prueba.
  • Puedes gestionar o cancelar tu suscripción en cualquier momento desde la configuración de tu cuenta de Apple ID (Ajustes → [tu nombre] → Suscripciones) o de Google Play (Play Store → Menú → Suscripciones) — cancelar dentro de la app por sí solo no es suficiente.
  • No se emiten reembolsos por la parte no utilizada de un periodo ya pagado, salvo cuando lo exija la ley aplicable o las políticas propias de reembolso de Apple o Google.
  • Los precios pueden variar según la región y están sujetos a cambio; notificaremos con anticipación a los suscriptores activos sobre cambios de precio, conforme a las políticas de la tienda correspondiente.
  • Las compras dentro de la app están protegidas detrás del PIN del adulto responsable y nunca son accesibles directamente desde el perfil del niño.

10. PROPIEDAD INTELECTUAL

Todo el contenido, diseño, código y materiales de ETERNAL están protegidos por derechos de autor. Queda prohibida su reproducción sin autorización.

11. CANCELACIÓN Y ELIMINACIÓN DE DATOS

El tutor puede eliminar la cuenta en cualquier momento o solicitar la eliminación total de los datos del menor. También podremos suspender cuentas que incumplan estos términos.

12. LEGISLACIÓN APLICABLE

Estos términos se rigen por las leyes de México, así como por normativas internacionales aplicables en materia de protección de datos infantiles.
